What is the Difference Between Revocable and Irrevocable Trusts?
Should you use a revocable family trust when planning your estate? And what tools are successful families using to plan to their estates? The problem with revocable trusts is that your assets are not protected from your creditors and those assets are still subject to inheritance tax. In many cases, those results are highly undesirable. Sophisticated estate planning might use a revocable trusts and will in combination with irrevocable trusts. For example, owning your own life insurance can be subject federal estate tax, currently at 35% but it could go back to 55%. Many sophisticated estate planners own their life insurance under an irrevocable trust. This takes the asset out of their estate making it worth much more than if it were left in the estate. Irrevocable trusts can also be used to move assets to the next generation while still allowing access to the living owners. These are complex techniques and not for everyone. Do I Need A Durable Power of Attorney?
How is a power of attorney different for a family that is using a sophisticated method of estate planning versus a family that using simple methods like a trust or will? First, let's review the concept of a power of attorney. If you become incapacitated and have designated a spouse, child or neutral 3rd party as your power of attorney, the designated party can handle your affairs. Regardless of the type of estate planning you are doing, you should have a power of attorney. Without one, no actions could be taken without going to court and having a judge confirm any actions beforehand. This is a time consuming and difficult process. As part of a durable power of attorney, we can grant authority to the people you designate to move funds, continue to plan your estate and run a family business even while you are incapacitated. This is not a simple form; it is a complicated procedure and it's not right for everyone. What is a Grantor Retained Annuity Trust?
There is a lot of confusion about GRATs, also known as Grantor Retained Annuity Trusts. Have they been eliminated? Do they still work? Let's start by clarifying what a GRAT actually is. This technique was perfected by Audrey J. Walton and some GRATs and even known as Walton GRATs. Mrs. Walton was widowed and wanted to provide more assets from her late husband's estate to her children. There is a very strict limit on how much she could give away and she wanted to give more than the $10,000 that was allowed at the time. She took some stock and put it in a GRAT. This meant that over a period of years, she would get all of that money back and the family would pay some interest on it. What was the point of this if she wasn't making money on the stock? Mrs. Walton suspected was that the value of this stock would increase dramatically and it turned out she was right. Because it was in a GRAT, her heirs were able to keep all of the increased value and were able to return her investment.
There have been many efforts in Congress to eliminate short term GRATs which last only a few years. No laws have been passed and for the time being, GRATs remain a very effective estate planning technique. This is a sophisticated estate planning method that is used only when there is strong chance that the investment will bring a high return. What is a Qualified Personal Residence Trust?
If you are planning your estate and are considering gifting your house to a child, you should first consider the consequences of this decision. Whether you have simple estate planning needs or more sophisticated needs, you need to be very careful about handling your home in a will because of complications with taxes and family dynamics. Here is an example of a why gifting a house to a child may not be a good idea. If you designate your home to a child while splitting up assets between other children and for some reason burn through those assets while you are still alive, one child will now have gotten a house and the others have gotten nothing. You should also consider that your child will now be responsible for paying taxes on the home whether they are in a financial position to do so or not.
There is a tool called a qualified personal residence trust that allows you to give away a home but continue to live in it for a set period of time. The only downside to this is that at the end of that 5 or 10 years, you will have to rent your own home from your child at fair market value. This can be a powerful technique if used properly. What is a Beneficiary Controlled Trust?
When planning an estate, people often want to know if they can give something away and still protect it. For example, can you give money to a child or grandchild and make sure they don't lose it in a divorce, car accident or some other traumatic event. There is a way to protect money but you can't give the money outright. There are many risks associated with giving someone money outright but many people do it because there is no cost associated with it. One of the alternatives to giving money outright is creating what is called a beneficiary controlled trust. The money is then moved into a trust rather than directly into the hands of the heir. You can make your child the trustee or appoint a trustee to control how much money they receive and when they will receive it. You can also build in flexibility that will allow them to use the money for investments.
